As A Woman Thinking Of Divorce, Is It Necessary To Hire A Divorce Lawyer?

Copyright © 2007-2008 Cathi Adams

Couples finding themselves in the middle of divorce proceedings are growing in number each year. Some studies are showing that over 50% of first time marriages will end in divorce, with subsequent marriages ending at even higher percentages! That means a lot of people looking for the expertise of divorce lawyers.

However, is there really a need for the hiring of an attorney? There are no written laws or requirements that state a divorce must be handled by lawyers. Many times, hiring a lawyer and doing none of the divorce work yourself can lead to tens of thousands of dollars in legal fees.

Women need to look out for their best interests when it comes to a divorce, though. Many times, emotions might get in the way of good judgment, and when children are involved, a lack of good judgment can be detrimental. So, with a little research, finding a balance between a doing some of the leg work yourself and using a lawyer may be just what is needed.

Sometimes, there are legal issues involved with divorce that women may not be aware of. This is where a lawyer can come in handy. They are prepared and trained to look for these legal issues, while also being able to handle transferring the ownership of personal property from one spouse to the other. When the marriage has lasted many years, there is also the possibility of assets becoming so "mixed up" that both parties need help untangling them. If missed, and the "do it yourself" divorce is finalized, it will be much more difficult to change what has been ordered by the court.

For anyone facing a divorce, the hiring of an attorney is an important step. Some things to remember, though, are:

  • Think ahead. Have a 'snapshot' of your marital finances BEFORE your first visit to the lawyer.

  • Don't allow emotions to run your divorce. In the end, a divorce is a business transaction that needs to be completed quickly. Allowing emotions, such as anger, anguish, hostility and rage run your divorce will not only make it many times more painful, but it will also make it many times more expensive. Lawyers often give a free consultation, but after that their time is expensive! Think of the statement: "Marriage is about love, Divorce is about money". That keeps the divorce on the right track.

  • Take your time and find a lawyer you trust. Some divorce lawyers are looking to "go for the spouse's jugular", and those types of lawyers may not be thinking of what is in their client's best interest.

  • Plan to do much of the pre-divorce preparation in a "do it yourself" style. The more that can be agreed on without the lawyers, the less it will cost in the end.

Divorce must be thought of from a business standpoint. Women, more than men, may find that to be difficult, but it can be done. The more emotions can be kept out of the process, the more quickly, fairly and inexpensively the divorce settlement can be reached.
